We discuss five kinds of representations of rationales and provide a formal account of how they can alter disputation. The formal model of disputation is derived from recent work in argument. The five kinds of rationales are compilation rationales, which can be represented without assuming domain-knowledge (such as utilities) beyond that normally required for argument. The principal thesis is that such rationales can be analyzed in a framework of argument not too different from what AI already has. The result is (...) a formal understanding of rationales, a partial taxonomy, and a foundation for computer programs that represent and reason with rationales.The five kinds of rationales are as follows: (c)ompression and (s)pecialization, which yield rules, and (d)isputation, which yields a decision. These are modeled as potentially changing the focus of the dispute. Then there are (f)it, a rationale for rules, and (r)esolution, a rationale for decisions. Most people presume that government is always responsible for providing solutions to pollution problems, including transportation pollution. This paper examines the validity of this argument from a minarchist libertarian, property rights principles perspective, and concludes that government cannot solve these problems using command-and-control legislation. The primary policy suggested for government to adopt is the strict adherence to property rights protection and enforcement regarding polluters, including themselves. Further encouragement of market forces could be accomplished by stopping interference within the market at (...) critical points, namely the production of roads, production and sales of automobiles, and the subsidization of alternative fuels. We present a mathematical approach to defeasible reasoning based on arguments. This approach integrates the notion of specificity introduced by Poole and the theory of warrant presented by Pollock. The main contribution of this paper is a precise, well-defined system which exhibits correct behavior when applied to the benchmark examples in the literature. It aims for usability rather than novelty. We prove that an order relation can be introduced among equivalence classes of arguments under the equi-specificity relation. We also prove (...) a theorem that ensures the termination of the process of finding the justified facts. Two more lemmas define a reduced search space for checking specificity. In order to implement the theoretical ideas, the language is restricted to Horn clauses for the evidential context. The language used to represent defeasible rules has been restricted in a similar way. The authors intend this work to unify the various existing approaches to argument-based defeasible reasoning. One, it is said, went insane, another became a heretic, a third died and only the (...) fourth emerged unscathed. A modern variation of this story might go like this. Four or perhaps  philosophers entered the jungle of nationalism and for the most part went insane. There were those who embraced nationalism and consequently abandoned the universality of philosophy for the promotion of xenophobia, racism and even Nazism. Others remained internationalist and hence became futile—philosophical Canutes—commanding the raging beasts of nationality to be still. No one struggled harder with nationalism than Bertrand Russell. In , writing as an internationalist, he announced the demise of the principle of nationality only to see nationalisms explode in every region of the world (see his “National Independence and Internationalism”, Papers ). He opposed it relentlessly and without compromise until near the end of his life when he found himself endorsing wars of national liberation. Nationalism is often depicted as a howling beast. It would be better to think of it as an anaconda that wraps itself around everyone who ventures into its domain. Joan Cocks’ Passion and Paradox is an important book on nationalism and the intelligentsia. She traces the intellectual encounter with nationalism of a number of figures—Karl Marx, Rosa Luxemburg, Isaiah Berlin and the Scottish nationalist Tom Nairn, among others. All are exiles, most are Jews, and all try to hack their way through a jungle of conundrums of nationalist thought. Her accounts of these thinkers sometimes read like complex legal briefs, but are always illuminating. Though an internationalist, she sees the power of nationalist imperatives. Her approach to the contradictory strains of nationalism and hostility to nationalism echoes that of Hegel. She presents critical but sympathetic accounts of each side of the nationalist problematic and shows how their difficulties might be resolved in a higher synthesis. Alas! her resolution suffers from the unworldliness that she finds in other versions of internationalism. Her argument begins with a personal experience. In the early ’s she joined a group of Arabs and Jews against the Gulf War. In the course of their associ- Reviews  ation she learned that the Jews were all internationalists, while the Arabs were outspoken nationalists. This experience presumably demonstrated that a happy collusion of nationalism and internationalism was possible. But, of course, there was another side: those prosecuting the war she opposed were also nationalists. Her central thesis addresses the tragedy of opposition. It states that nationalism is “dilemmatic”, that is, that “all paths of thought obscured equally telling contrary thoughts; all courses of action were strewn with causes for regret and remorse” (p. ). The horns of the dilemma are the valid claims of the internationalist who sees the underlying self-destructive deep structures of nationalism on one side, and the claims of the national particularistic who is engaged in the compelling theatre of national liberation and the protection of local customs and roots on the other. Her book is an account of how her thinkers are framed by this dilemma, locked in by the imperatives of either side. In the period between the Gulf War and the composition of this book in  Cocks was able to observe what she identifies as the destructive logic of nationalism. The ’s were a period of postmodernist celebration of the local, a sensibility that helped to legitimate nationalism. The explosion of nationalism that followed the breakup of the Communist imperium was a time of liberation of the imprisoned nations—a springtime when it was good to be alive. But as the decade wore on the concealed pit bulls came out—in Yugoslavia, in Rwanda and elsewhere. In Cocks’ view nationalism showed an inner logic, of a sort that Russell called attention to in the early ’s—a logic that led from euphoria to self-destruction (see his Prospects). Louis Charland has argued that the Cluster B personality disorders, including borderline personality disorder, are primarily moral rather than clinical conditions. Part of his argument stems from reflections on effective treatment of borderline personality disorder. In the argument from treatment, he claims that successful treatment of all Cluster B personality disorders requires a positive change in a patient’s moral character. Based on this claim, he concludes (1) that these disorders are, at root, deficits in moral character, and (2) that (...) effective treatment of these disorders requires a sort of moral education rather than clinical intervention. In this paper, I evaluate the argument from treatment through a critical analysis of two psychotherapeutic interventions that have shown recent effectiveness against borderline personality disorder. I suggest that both Dialectical Behaviour Therapy and Mentalization-Based Treatment indicate that borderline personality disorder is, at root, a deficit in non-moral cognitive and emotional capacities. I suggest that these non-moral deficits obscure the expression of an otherwise intact moral character. In light of this, I conclude that effective treatment of borderline personality disorder requires primarily clinical intervention rather than moral edification. (shrink)

A recurring problem in psychiatry is the meaningfulness, or otherwise, of its domain. Critics of psychiatry accuse the discipline of misconstruing mental phenomena and behavior, including the verbal sort, as meaningless symptoms, in keeping with other medical specialisms. A myoclonic jerk is taken by the neurologist to mean nothing beyond signaling pathology of the nervous system. But this approach, critics argue, strips psychiatric phenomena of their meaning. Accordingly, Louis Sass has described a tendency, "particularly among organic psychiatrists… to ignore (...) the psychological interpretation or empathic understanding of mental symptoms". Words of Life is the sequel and companion to Phenomenology and the "Theological Turn," edited by Dominique Janicaud, Jean-Francois Courtine, Jean-Louis Chrétien, Michel Henry, Jean-Luc Marion, and Paul Ricoeur. In that volume, Janicaud accuses Levinas, Henry, Marion, and Chrétien of "veering" from phenomenological neutrality to a theologically inflected phenomenology. By contrast, the contributors to this collection interrogate whether phenomenology's proper starting point is agnostic or atheistic. Many hold the view that phenomenology after the theological turn may very well be (...) true both to itself and to the phenomenological "things themselves." In one way or another, all of these essays contend with the limits and expectations of phenomenology. As such, they are all concerned with what counts as "proper" phenomenology and even the very structure of phenomenology. None of them, however, is limited to such questions. Indeed, the rich tapestry that they weave tells us much about human experience. The first three essays (...) focus primarily on advancing the general interpretive claim that Descartes’s main epistemological goal is achieving unshakable beliefs. While essays 5–10 address many topics in Humean interpretation, they all contribute in various ways to supporting Loeb’s claim that Hume’s primary epistemological goal is achieving stable beliefs. Essay 12 compares the naturalisms of Hume and Reid. All of the collected essays are excellent.Such excellence is not surprising, for Loeb is an influential interpreter of early modern philosophy, justly renowned for the ingenuity of his readings. Spanning the last three decades, these essays display many fine qualities that have helped make Loeb such a prominent historian. Here I will briefly mention three of these qualities. First, Loeb has remarkable command of the primary historical texts and the secondary literature. This mastery is perhaps best seen in his “What is Worth Preserving in the Kemp Smith Interpretation of Hume?” (essay 9). In addition to providing a detailed exposition of a wide range of texts from Hume and Norman Kemp Smith, Loeb also makes adroit comments about the literature discussing the secondary literature when he addresses the “Canonical Understanding” of Kemp Smith (246–47). Second, Loeb effortlessly integrates historical and contemporary concerns. His “Hume’s Agent-Centered Sentimentalism” (essay 8), for instance, has [End Page 257] an interesting discussion of how Hume’s moral theory might aid contemporary utilitarians (238–44). Moreover, essays 5 (“Integrating Hume’s Accounts of Belief and Justification”) and 10 (“Psychology, Epistemology, and Skepticism in Hume’s Argument about Induction”) fruitfully discuss Hume’s epistemology in light of issues important to the contemporary distinction between internalism and externalism. Third, Loeb’s intuitive knack for isolating important connections amongst various texts and figures allows him to tell a concise story about the evolution of certain philosophical ideas that panoramically covers large portions of the history of philosophy. His “Locke and British Empiricism” (essay 11), which connects epistemological themes in Locke with Descartes, Hume, Berkeley, Malebranche, and Reid, among others, is one example. (Because this essay is, as of this writing, still forthcoming, it is the only essay that is not previously published.) Finally, all three of these qualities are prominently on display in “Sextus, Descartes, Hume, and Peirce” (essay 4), which interestingly uses contemporary views about belief (especially as developed by David Velleman) to understand Descartes and Hume “against the backdrop of Sextus and Peirce” (107). To my mind this essay is the best in the book.There are at least two main advantages of collecting these excellent essays into a book. First, the collection allows Loeb to systematically emphasize the similarities between different early modern thinkers in a way that typically strengthens the cumulative case he makes for his readings of these philosophers. Second, the volume permits us to catch a rare glimpse of how an interpreter’s views can change over time. Considering the cumulative effect of the arguments as well as the changes in Loeb’s views also provides us with a great opportunity to reflect critically on many important issues in a fruitful way. The rest of this review will focus on such critical reflections.Let us start with Descartes, as Loeb does. In his introduction to the essays, Loeb helpfully contextualizes his discussions of Descartes. He points out that his paper “Was Descartes Sincere in His Appeal to the Light of Nature?” (not included here) maintains that the arguments Descartes presents are so poor that they “suggest” that “Descartes was insincere in offering his proofs of the existence of God and in appealing to Divine veracity to validate clear and distinct perception” (9; cf. 35). Of course others have likewise contended that Descartes was a dissimulator. But in the first four chapters... (shrink)

This article recovers a largely forgotten and quite surprising argument about the origins of political liberty in Britain: that the Norman Conquest, by making possible an extremely powerful absolute monarchy, paradoxically set in motion the historical process which would later lead to the emergence of limited constitutional monarchy. The article shows how the eighteenth-century writer Jean Louis de Lolme initially made this argument to explain the divergent constitutional orders of Britain and France. De Lolme’s hypothesis was then taken (...) up by numerous historians and political theorists. François Guizot and his fellow Doctrinaires, Alexis de Tocqueville, and John Stuart Mill were among the writers who further developed his historical explanation of the British constitution. The liberal philosophy of history in the nineteenth century sprang from De Lolme's account of how absolute monarchy leads paradoxically to constitutional liberty. (shrink)

The Pāli expression khaggavisāṇakappo may either mean ‘like the rhinoceros’ or ‘like the horn of the rhinoceros’. It occurs in the refrain eko care khaggavisāṇakappo at the end of each stanza of the Khaggavisāṇasutta and its parallels, and the refrain has been translated by some as ‘one should wander alone like the rhinoceros’ but by some, including K.R. Norman, as ‘one should wander alone like the horn of the rhinoceros’. K.R. The present article critically discusses Norman’s reasons, concluding that the expression khaggavisāṇa may be regarded as a deliberately ambiguous compound meaning both the rhinoceros and its horn, or perhaps as a single expression meaning ‘rhinoceros’. The zoological facts are considered, as well as the difficult etymology of khaggavisāṇa, its contextual meaning, its meaning in Jain parallels, and its discussion in Pāli commentaries. Some found it both at once.The series has unforgettable moments: spectacular jitterbug sequences; Jimmy Lunceford's horn men fanning their trumpet (...) bells with hat mutes in sync; the close-up of the whirring cross-hand drumming of Art Blakey; the bitter-sweet glance Billie Holiday and Lester Young exchange in their last filmed appearance together; the occasional marriage of visuals to music. One riveting three minutes comes when the talking heads tune out, a 78-rpm disk of Louis Armstrong's "West End Blues" is set spinning, and the thrilling notes pour out on a carousel of visual imagery—finally freeze-framing on the face of the young genius himself.On the downside, the series is massively repetitious. As a result of Burns's decision to track two major figures—Louis Armstrong and Duke Ellington—from cradle to grave, the same cuts of Armstrong appear again and again, no matter what the time frame. Some of the series' commentators are particularly annoying—the fiddler of Burns's Civil War series, Matt Glaser, for instance, with his fatuous theories [End Page 157] about Louis Armstrong and Albert Einstein. But Burns pays a price here, as he did in his documentary about baseball, in which not even the basics of the game, let alone any of the subtleties, were explained. In "Jazz" we get no explanation of what Jelly Roll Morton did to transform ragtime into jazz. (The series could easily have pressed Morton himself into service. With no sacrifice of his considerable charm, Morton did explain it, beautifully, in his recorded Library of Congress interviews. 4) Although the swing era gets big billing, no attempt is made to explain how swing rhythm actually works, as contrasted with earlier practices. (I have watched swing drummer Panama Francis entertain a packed hall with a brief but riveting illustration of how it works.)As jazz history, the film also has problems. Some legendary figures are resurrected unconvincingly. When Marsalis tells us what the legendary trumpet player Buddy Bolden sounded like, the illustrative off-camera trumpet is Marsalis's, not Bolden's, who embedded not one note in a record groove. Further, we face the tiresomely obvious problem of omissions. We hear nothing of Albert Ayler, Keith Jarrett, Sun Ra, Mildred Bailey, Benny Carter, Lennie Tristano, Erroll Garner, Eric Dolphy, Art Pepper, or Woody Herman. All we learn about Bill Evans—whose influence on jazz piano was huge—is that Miles Davis hired him even though he was white. Omissions are inevitable, of course. But there is a muted pattern to the exclusions. It was impossible for the series to avoid Benny Goodman, given his central role in the swing era. But white figures are too often either ignored or treated as alienated outsiders. We hear New York Times columnist Margo Jefferson opine that Bix Beiderbecke drank himself to death because he wasn't allowed to play with black musicians. In fact, many of the greatest players—white and black—never played with musicians of their own caliber.Most figures covered in the film are treated either with respect or with reverence. But things get nasty when matters turn to avant-gardists. Stability and Justification in Hume's Treatise. New York: Oxford University Press, 2002. Pp. xvi + 280. Cloth, $42.50. As is well known, in the last year of his life, Hume repudiated his Treatise of Human Nature in an Advertisement that he had placed at the front of the volume of his writings (...) containing his mature philosophical works. He asked that only the two Enquiries and other later philosophical writings be regarded as the source of "his philosophical sentiments and principles." But not leaving it at that, he admitted that there were "negligences in his... reasoning" and in his manner of expressing himself in the Treatise. More than twenty years earlier, Hume had admitted that publishing the Treatise in its imperfect state in his youth constituted "a very great Mistake in Conduct." But he did not have sufficient foresight to see that the admission he made in his old age constituted at least as bad an indiscretion of the same kind. Acknowledging mistakes in reasoning and in expression for a philosopher [End Page 562] is like waving a red flag in front of a bull. Two bulls in fact: the philosopher and the "reconstructive" historian of philosophy. The former is given ample work in correcting the older philosopher's mistakes; the latter in devising an interpretation of a text that apparently leaves itself open to many. Hence the immense popularity that Hume's Treatise of Human Nature has enjoyed in the two and a half centuries since he asked that it be disregarded. Who cares about "his philosophical sentiments and principles" anyway?Louis Loeb's study of epistemology in Hume's Treatise is both an exercise in "reconstructive history of philosophy" and a philosophical emendation of Hume's (reconstructed) "philosophical system." The first task is pursued in the first five chapters of the book; the second in the last two. "Reconstructive history" as practiced by Loeb does not try to provide "a balanced commentary" but rather "an illuminating and fruitful interpretive perspective" (viii) on what a philosopher has written. Loeb's perspective on Hume's epistemology is derived from details of Hume's psychology of the imagination developed mainly in sections 9-13 of part 3 of book 1, details which Hume himself considered "unnecessary" to the exposition of his mature epistemology in the first Enquiry. Loeb's philosophical emendations derive from his claim that Hume made certain mistakes which led him to despair of the success of his project and settle for sceptical conclusions in part 4. In the last two chapters of the book Loeb seeks to save Hume from his own sceptical conclusions.Loeb regards his account as a development and correction of the kind of naturalistic interpretation of Hume's epistemology that was originally developed by Norman Kemp Smith (21). A naturalistic theory of justification, according to Loeb, is one that grounds beliefs that one already considers to be justified in the psychological mechanisms that generate them. Whereas Kemp Smith argued that justification depends on the "irresistibility" or "inevitability" of the beliefs, Loeb holds that justification depends upon what he calls the "stability" of the belief generating mechanisms. A belief forming mechanism is stable just in case it produces a consistent set of beliefs that will stand up even under "reflection." For example, in part 3 of book 1 (81, 159, 238), Hume presents beliefs based on cause and effect as stable in this sense, and contrasts them with "unphilosophical" belief forming mechanisms such as indoctrination (education). Unlike the former, the latter mechanism generates beliefs that "are frequently contrary... to themselves in different times and places and is never on that account recognized by philosophers" (Treatise117). What a speaker intends to communicate is characteristically far richer than what she directly expresses; linguistic meaning radically underdetermines the message conveyed and understood. Speaker S tacitly exploits pragmatic principles to bridge this gap and counts on hearer H to invoke the same principles for the purposes of utterance interpretation. (...) The contrast between the said and the meant, and derivatively between the said and the implicated (the meant-but-unsaid), dates back to the fourth century rhetoricians Servius and Donatus, who characterized litotes—the figure of pragmatic understatement—as a figure in which we say less but mean more (“minus dicimus et plus significamus”; see Hoffmann 1987 and Horn 1991a for discussion). In the classical Gricean model, the bridge from what is said (the literal content of the uttered sentence, computed directly from its grammatical structure with the reference of indexicals resolved) to what is communicated is constructed through implicature. Several years in the making, the volume was edited by Patrick Henry, director of the Institute for Ecumenical and Cultural Research at St. John's Abbey in Collegeville, Minnesota. It (...) contains the reflections of four Buddhist authors—Norman Fischer, Joseph Goldstein, Judith Simmer-Brown, and Yifa—on selected parts of the Rule of Saint Benedict and has already met with such success that plans are underway to have it translated into several foreign languages.To coincide with the publication of the book, the Monastic Interreligious Dialogue (MID) board decided to hold a conference at Our Lady of Grace Monastery in Beech Grove, Indiana, from September 21-23, 2001. Originally all four of the Buddhist authors had intended to come, but in light of the terrorist attacks of September 11, Norman Fischer and Joseph Goldstein felt it was more important that they remain with their own communities during those days. However, Judith Simmer-Brown and Yifa did attend, along with more than a hundred other persons. The attendees included Father Patrick Barry, the former abbot of Ampleforth Abbey in England, who is currently residing at St. Louis Abbey in Missouri. His sensitive translation of the Rule of Saint Benedict is included as an appendix to Benedict's Dharma.On the opening evening, Father William Skudlarek, OSB, the chair of the MID board, extended a warm welcome to those attending and then introduced Patrick Henry, who served as moderator of the entire conference. Brother David Steindl-Rast, OSB, who had worked closely on the project from its inception and had written an afterword to the book, spoke on the Rule of Benedict as a "trellis," which is the root meaning of the Latin and Greek words translated as "rule." Just as a trellis in a garden provides a structure for the plant climbing on it, so does the Rule of Saint Benedict establish a framework on which a life can grow. Background In the UK, the solidaristic character of the NHS makes it one of the most trusted public institutions. In recent years, the introduction of data-driven technologies in healthcare has opened up the space for collaborations with private digital companies seeking access to patient data. However, these collaborations appear to challenge the public’s trust in the. Main text In this paper we explore how the opening of the healthcare sector to private digital companies challenges the existing social contract and the (...) NHS’s solidaristic character, and impacts on public trust. We start by critically discussing different examples of partnerships between the NHS and private companies that collect and use data. We then analyse the relationship between trust and solidarity, and investigate how this relationship changes in the context of digital companies entering the healthcare system. Finally, we show ways for the NHS to maintain public trust by putting in place a solidarity grounded partnership model with companies seeking to access patient data. Such a model would need to serve collective interests through, for example, securing preferential access to goods and services, providing health benefits, and monitoring data access. Conclusion A solidarity grounded partnership model will help establish a social contract or licence that responds to the public’s expectations and to principles of a solidaristic healthcare system. On 26 February 2020, the German Constitutional Court rejected a law from 2015 that prohibited any form of ‘business-like’ assisted suicide as unconstitutional. The landmark ruling of the highest federal court emphasised the high priority given to the rights of autonomy and free personal development, both of which constitute the principle of human dignity, the first principle of the German constitution. The ruling echoes particularities of post-war Germany’s end-of-life debate focusing on patient self-determination while rejecting any discussion of active assistance (...) to die through a lethal injection administered by a doctor. This brief report discusses the ruling in the light of the broader sociopolitical and historical context of the German end-of-life debate. (shrink)

In the modern age, the political secret has acquired a bad reputation. With modern democracy’s ideal of transparency, political secrecy is identified with political crime or corruption. The article argues that this repression of secrecy in modern democracies falls short of a substantial understanding of the structure and workings of political secrecy. By outlining a genealogy of political secrecy, it elucidates the logic as well as the blind spots of a current culture of secrecy. It focuses on two fundamental logics (...) of secrecy, deduced from the Latin terms ‘ arcanum’ and ‘ secretum’. Whereas the logic of arcanum regards secrecy as a legitimate dimension of government, a modern logic of secretum is marked by an inextricable dialectics between the withdrawal and communication of knowledge, between secrecy and publicity. Here, the secret is not so much a piece of withheld knowledge as a ‘secrecy effect’ that binds the realm of secrecy to the public sphere by a dialectics of permanent suspicion and scandal. Instead of falling into the trap of this ‘secrecy effect’ it is worth taking a closer look at the tradition of thought on the arcana imperii, from Tacitus to early modern doctrines of raison d’état to Carl Schmitt. What this tradition deals with is the functionality of secrecy and its complicated relation to the law. The arcana tradition elaborates the crucial point of secrecy: its potential, but also its profound ambivalence. Secrecy opens up a discretionary space of action exempt from the rule of law, and, according to Carl Schmitt, ignores the law so as to allow it to become effective. Secrecy serves to protect and stabilize the state, but at the same time it opens a space of exception from the rule of law that breeds violence, corruption and oppression. Instead of seeing secrecy as the opposite of a political culture of transparency, it is more productive to regard secrecy as transparency's complement – a counterpart, however, that is marked by the profound paradox of being both a consolidation of and a threat to democracy.
